Pursuant to the changes in the definition of a salesperson under Section 7 of the Real Estate Agents Act 2008 lawyers are now permitted to market properties. Lawyers are not required to be members of the REINZ and must charge in accordance with the same fair and transparent costing principles that lawyers are currently required to adhere to.

You will get the same service that is able to be offered by the current real estate selling providers. Currently Citylaw has Kim Hemus, an ex-real estate agent with some 20 years previous experience working for it in assisting clients in marketing their properties.
Lawyers are only able to charge a fee based on the work done so that the fee which you negotiate with your lawyer will be based on such things as time spent, the difficulty of the sale, the complexity of the sale, the skill and specialized knowledge required to conduct the marketing programme, the urgency and circumstances surrounding the matter, the degree of risk assumed by the lawyer and the contingent nature of the fee. Lawyers in other words must be able to justify their fee rather than simply basing the fee on the value of the property sold.
The result will be that you are likely to be paying substantially less for marketing services through your lawyer than you will currently pay through a real estate agent.
You will get legal advice in regards to selling your property from the outset and throughout the sale process rather than once the agreement is signed and binding on you which is more often the case now than not.
You will be encouraged to obtain independent and objective valuation advice prior to listing. This opposed to being inclined to accept the services of an agent who is offering their services to list your property at an inflated and unrealistic value.
Once an offer is received for your property you will have your lawyer protecting
your interests in respect of the contract, before you are bound by it.
You will get regularly updated throughout the sale process in respect of the marketing of your property.
